What a Catch & Off the Charts — Terms & Conditions

Before you book: Please take a moment to read through our Terms & Conditions below. By confirming your booking with What a Catch or Off the Charts, you acknowledge that you’ve read and agreed to the policies outlined on this page — including our booking, refund, and weather procedures. We’re all about creating safe, enjoyable days on the water, and these terms help us keep things fair and smooth for everyone.

1. Bookings & Payments

Exclusive (Private) Charters: • A $500 deposit is required to secure all exclusive charter bookings. • The balance is payable the day before your scheduled trip. • If weather or unforeseen circumstances require What a Catch or Off the Charts to cancel or reschedule your trip, your deposit will be fully refundable or transferred to another suitable date. • If you choose to cancel your exclusive charter, your deposit is non-refundable, but may be used as a credit towards another trip (with a minimum of 48 hours’ notice). Individual (Shared) Charters: • A valid credit card is required to secure all individual bookings. • The balance is payable on the day of your charter. • If weather or other operational factors require us to cancel or reschedule your trip, you’ll receive a full refund or the option to transfer to another date. • 48 hours’ notice is required for all cancellations. Failure to provide this notice will result in the full amount being charged to your card.

2. Weather, Safety & Confirmation

• All trips are weather dependent and subject to the discretion of the skipper for the safety and comfort of all guests. • Confirmation calls are made the afternoon before your trip (by 4:00pm) to confirm weather conditions and departure details. • We reserve the right to cancel, postpone, or alter trips at any time due to weather, mechanical issues, safety concerns, or other operational factors. • Safety is our top priority. Please follow all instructions from the crew at all times while on board. Failure to do so may result in termination of your participation without refund. • Passengers must disclose any medical conditions or mobility issues that may affect their ability to safely participate in the trip.

3. Liability & Risk Acknowledgement

• Participation in any fishing charter involves inherent risks, including (but not limited to) motion sickness, slips, trips, falls, and injury caused by fishing equipment or marine conditions. • By participating, you acknowledge these risks and agree that What a Catch and Off the Charts, their owners, employees, and agents will not be liable for any loss, damage, injury, or death arising from your participation, except where required by Australian law. • You are responsible for any personal belongings brought aboard. We accept no liability for loss or damage to personal property.

4. Alcohol & Behaviour

• Moderate alcohol consumption is permitted at the skipper’s discretion. Excessive drinking, intoxication, or unruly behaviour will not be tolerated. • The skipper reserves the right to refuse boarding or terminate a trip if behaviour endangers the safety or enjoyment of others. • Illegal substances are strictly prohibited.

5. Gift Vouchers & Credits

Gift vouchers and credits are non-refundable and valid for 12 months from the date of issue. • They may be used toward any charter, subject to availability and weather conditions.

6. Photography & Media

We occasionally take photos or videos during charters for promotional purposes. By joining a trip, you grant permission for your image to be used in marketing materials, unless you notify us otherwise in writing.

7. Website Use & Privacy

• By using our website, you agree not to reproduce, distribute, or exploit any content without our written consent. • We respect your privacy. Any personal information collected through bookings or inquiries is handled in accordance with the Australian Privacy Principles. • We only collect information necessary to process bookings, communicate with you, and improve our services.

8. Intellectual Property

All text, images, logos, and content on our website are the property of What a Catch and Off the Charts and may not be copied or used without permission.

9. Changes to Terms

We may update these Terms & Conditions from time to time. The most current version will always be available on our website.

10. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia, and any disputes will be subject to the jurisdiction of the courts of Queensland.

11. Damage or Loss of Equipment:

 Any customer who loses or damages fishing gear or equipment belonging to the vessel will be charged a replacement or repair fee, calculated based on the item’s value.
